Google seeks dismissal of Oracle lawsuit

October 6, 2010 —  Google asked a California federal court on Monday to dismiss a lawsuit filed by Oracle, denying Oracle’s claim of copyright infringement in development of Android smartphone software.

Oracle sued the Web search giant in August, alleging that Android violated key Java patents (acquired in Oracle’s purchase of Java inventor Sun Microsystems) when Google implemented its own JVM for the Android mobile platform.

According to court documents, Google said Oracle’s claims of copyright infringement are broad and vague. “The complaint does not specifically identify any allegedly infringing works of Google,” the company said.

In addition, “Oracle’s claim of copyright infringement fails to meet the pleading standards applicable to a claim of copyright infringement,” Google said.

Google also pointed out that before its acquisition, Sun declared Java open source and therefore publicly available for use.
